Assumption of Risk & Liability Waiver

Participant Eligibility

I represent and warrant that I am at least 18 years of age, or, if the participant is a minor, that I am the legal parent or guardian with authority to consent on their behalf. I agree to this Waiver on behalf of myself, my heirs, assigns, and next of kin.

By registering for, attending, or participating in any practice, game, pickup, league, tournament, or related activity (“Events”) hosted, organized, or affiliated with Bay Area Champions Foundation (and its affiliates), I agree to the terms below.

Assumption of Risk

I understand and acknowledge that participation in soccer and related activities involves inherent and significant risks, including but not limited to:

  • Physical contact and collisions with other participants
  • Uneven, slippery, or adverse field conditions
  • Sprains, strains, fractures, dislocations, concussions
  • Serious injury, permanent disability, paralysis, or death
  • Property damage or loss
  • Exposure to communicable or infectious diseases
  • Travel-related risks, vehicular or pedestrian traffic

I understand that these risks may arise from my own actions or inactions, the actions or inactions of others, field conditions, equipment, weather, or negligence of Bay Area Champions Foundation or other participants.

I knowingly, intelligently, and voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, anticipated or unanticipated.

Physical Fitness & Player Responsibility

I certify that I am physically fit and capable of participating and have not been advised otherwise by a qualified medical professional. I agree to inspect facilities, equipment, and playing surfaces before participation and to remove myself immediately if I believe conditions are unsafe.

Bay Area Champions Foundation does not guarantee field safety and does not evaluate individual skill or health prior to participation.

Waiver & Release of Liability

To the fullest extent permitted by California law, I hereby waive, release, discharge, and agree not to sue:

Bay Area Champions Foundation, Daniel Pena, The Art of Football LLC, and all directors, officers, volunteers, staff, contractors, agents, coaches, referees, sponsors, venue owners, and affiliates (collectively, the “Releasees”)

from any and all claims, liabilities, demands, damages, losses, costs, or expenses, including those arising from negligence, related to my participation in any Event.

Indemnification

I agree to indemnify, defend, and hold harmless the Releasees from any claim, demand, or liability arising from my participation, conduct, or presence at any Event.

Medical Treatment Consent

In the event of injury, illness, or emergency, I authorize Bay Area Champions Foundation to obtain emergency medical treatment deemed appropriate and release all involved parties from liability related to such care.

Media Release

I grant Bay Area Champions Foundation the irrevocable right to photograph, record, and use my name, image, likeness, voice, and participation for promotional, educational, or marketing purposes, without compensation.

Code of Conduct Acknowledgment

I agree to comply with all rules, instructions, and codes of conduct established by Bay Area Champions Foundation. Violence, threats, harassment, or unsafe conduct may result in immediate removal and permanent suspension, without refund.

Refund & Cancellation Acknowledgment

I understand that all payments are non-refundable, including cancellations due to:

  • Personal unavailability
  • Suspension or removal
  • Field, weather, or schedule changes

Credits may be issued at the sole discretion of Bay Area Champions Foundation.

California Civil Code §1542 Waiver

I knowingly waive my rights under California Civil Code Section 1542, which states:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist…”

Legal & Electronic Acceptance

This Agreement shall be governed by the laws of the State of California. If any portion is deemed invalid, the remainder remains fully enforceable.

By checking a box, submitting registration, or completing payment, I confirm that:

  • I have read and understand this Waiver
  • I knowingly accept all risks
  • I voluntarily waive liability
  • I agree to be legally bound by these terms
